Rules for buying and selling goods in the e-shop Gipsygarden

1. General provisions

1.1. These e-shop rules (hereinafter referred to as the “Rules”) are a legal document binding on the Buyer and the Seller (hereinafter referred to as the Seller) defining the rights and obligations of the Parties, the conditions and procedure for purchasing, paying for, delivering and returning conditions for selling in an e-shop.

1.2. For the purposes of these Rules, a buyer is a person who has registered and purchased in the e-shop. You can buy in the e-shop:

1.2.1. an active natural person, i. a person who has reached the age of majority and whose capacity is not restricted by court order;

1.2.2. a minor between the ages of 14 (fourteen) and 18 (eighteen) who has the consent of his or her parents or guardians, except in cases where he or she is emancipated;

1.2.3. legal person.

1.3. By registering or placing an order, the Buyer unconditionally confirms that he has the right to buy in the e-shop.

1.4. Seller reserves the right to change, amend or supplement these Rules at any time. The Buyer is informed about the changes in the Rules on the e-shop website. The changes take effect from the moment of publication for all transactions concluded after the announcement, therefore the Buyer is recommended to get acquainted with the Rules during each purchase.

1.5. The Seller is released from any liability if the Buyer has not been partially or completely acquainted with the rules on the website, even though he has been given such an opportunity.

2. Conclusion of a purchase and sale agreement

2.1. The purchase and sale agreement between the Buyer and the Seller is considered concluded when the Buyer forms and submits an order for goods in the e-shop, and the Seller confirms it in writing.

2.2. After concluding the Purchase and Sale Agreement, the range of goods, their quantity, price, delivery time and other conditions specified during the Buyer's order are binding on the Buyer and the Seller, and may be changed only in accordance with the procedure established in these Rules.

2.3. Purchase and sale agreements are registered and stored in the Gipsygarden database.

3. Buyer's rights

3.1. The buyer has the right to purchase goods in the online store Gipsygarden in accordance with these Rules.

3.2. The Buyer has the right to withdraw from the purchase and sale agreement concluded in the e-shop by notifying the Seller thereof in writing no later than within 14 (fourteen) calendar days from the date of delivery of the goods.

3.3. The Buyer's right discussed in Clause 3.2 shall be exercised in accordance with Article 6.22810 (1) of the Civil Code.

3.4. The Buyer may exercise the Buyer's right discussed in Clause 3.2 only if the goods have not been damaged or their appearance has not substantially changed, as well as if they have not been used.

3.5. Cancellation or adjustment of the ordered and formed Shopping Cart is not possible.

4. Seller's Rights

4.1. If the Buyer tries in any way to damage the operation of the online store, data security or violates other obligations of the Buyer mentioned in clause 5, then the Seller has the right to restrict the use of the online store Kalnų namai.

4.2. When the Buyer chooses to pay for the goods in cash by picking up the goods or after prepaying and failing to contact the Buyer within the specified time according to the chosen delivery method, then the order is canceled and returned to Gipsygarden

5. Obligations of the Buyer

5.1. The Buyer must pay for the purchased goods and accept them in accordance with the procedure provided for in these Rules.

5.2. If the Buyer, during the delivery of the goods, refuses to accept the goods without important reasons, the Buyer must cover the costs of returning the goods upon the Seller's request.

5.3. The buyer undertakes to store and not pass on to third parties his login details to the online store Gipsygarden. 5.4. The Seller is not responsible for the actions of third parties using the Buyer's login data until the moment of notification and the possibility for the online store administrator to change the Buyer's login data. In this case, Gipsygarden has the right to assume that the actions in the online store were performed by the Buyer.

5.5. Buyers of the online store Gipsygarden must comply with these Terms and Conditions, which are clearly indicated in the information sections of the online store and do not violate the legal acts of the Republic of Lithuania.

6. Obligations of the Seller

6.1. The Seller undertakes to make available the services of the online store, the operating conditions of which are determined by these Rules and other conditions published in the online store Gipsygarden.

6.2. The Seller undertakes to deliver the goods purchased by the Buyer by the delivery method chosen by the Buyer, based on the conditions established by these Rules.

6.3. The Seller undertakes to respect the Buyer's right to privacy of personal information belonging to him.

6.4. When due to unforeseen circumstances the Seller is unable to deliver the goods purchased in the online store Gipsygarden, the Seller has the right to terminate the Purchase Agreement by notifying the Buyer in advance. The seller can offer a similar product. If the Buyer refuses, the Seller undertakes to return the money paid within 7 (seven) business days.

6.5. By using the Rules 3.2. the right provided for in paragraph 3.4. the Seller undertakes to return the money paid to the Buyer within 7 (seven) days from the day when the returned goods are delivered to the Seller.

6.6. The Seller may not refund the amount of money paid by the Buyer until the goods have been returned to the Seller or until the Buyer provides proof that the goods have been sent to the Seller, whichever is the earlier.

6.7. The Seller undertakes to provide the Buyer with the information set forth in Article 6.2287 of the Civil Code of the Republic of Lithuania in a clear and comprehensible manner.

7. Prices of goods

7.1. The prices of the goods in the online store and in the formed order are indicated in the currency circulating in the country.

8. Ordering goods and paying for goods

8.1. After visiting the e-shop, the buyer selects the goods he likes, on the basis of which a shopping cart is formed. After creating the shopping cart, the Buyer enters the data necessary for the delivery and purchase of the selected goods: his name, surname, address at which the goods will be delivered, telephone and additional information that may be relevant for the delivery of the ordered goods.

8.2. The order is transferred for further execution only from the moment when the bank transfer is settled, the contract is considered executable when the Buyer's payment is received; when paying in cash or by bank card during the delivery / collection of goods - the contract is considered enforceable from the moment the Buyer confirms his order in the store.

8.3. The customer can pay for the goods in one of the ways and conditions provided by the e-shop:

8.3.1. Bank transfer;

8.3.2. cash or bank card upon delivery / collection of goods.

8.3.3.Pay pal payment

8.3.4 Using Swedbank, Seb, Luminor, Citadele and Šiaulių bankas electronic banking services. Payments are available in euros. Payments are processed using the MakeCommerce.lt payment platform. ”

8.4. The prices of the goods in the e-shop and in the final order window are indicated in euros

9. Exchange of information

1211. The Seller informs the Buyer using the e-mail provided in his registration form. e-mail address, and the Buyer can use all the communication channels listed in the "CONTACTS" section of the Gipsygarden online store website.

12. Liability

12.1. The buyer is fully responsible for the accuracy of the data provided in the registration form. If the Buyer provides inaccurate data in the registration form, the Seller shall not be liable for the consequences thereof and shall acquire the right to claim compensation for direct losses incurred by the Buyer.

12.2. The buyer is fully responsible for his actions performed by registering in the online store Mountain House.

12.3. The buyer is responsible for the security of his registration data. If the registration data is used by a third party, it will be considered a Buyer.

12.4. The Seller is released from any liability in all cases where the loss arises due to the fact that the Buyer, despite the recommendations of the Seller and his obligations, did not read these Rules (although he was given such an opportunity).

12.5. In the event of damage, the guilty party shall indemnify the other party for the losses incurred in accordance with the procedure and on the grounds established by the legal acts of the Republic of Lithuania.

13. Marketing Measures Applied by the Seller

13.1. The seller may carry out various types of promotions, change their terms or terminate them.

13.2. The buyer, agreeing to his specified e-mail. Information notices (newsletters) about Gipsygarden.com promotions and offers would be sent to the e-mail address, tick the consent during registration. At the Buyer's request, the Seller will not use the Buyer's personal data for marketing purposes and will not send the Buyer any advertising or information messages other than those necessary for the execution of the order submitted by the Buyer.

13.4. The Seller may provide the Buyers with virtual monetary units (Coupons), which will be used to pay for the purchased goods only in the online store. Coupons are one-time (non-aggregate), one coupon can be used in one order.

13.5. In the event that the Buyer acquires a product, which uses the Coupons and makes use of Clause 3.2 of these Rules. The right to return the goods provided for in paragraph 1, the amount of the Coupons used for the purchase shall be deducted from the amount to be returned to the Buyer for the returned goods. Coupons are one-time and are non-refundable. In case of return of the goods, the Coupons are not returned to the Buyer. Coupons are not exchangeable for cash.

14. Final provisions

15.1. These Rules have been drawn up in accordance with the legal acts of the Republic of Lithuania.

15.2. These Rules and the relations between the Parties with respect to these Rules shall be applied and interpreted in accordance with the laws of the Republic of Lithuania.

15.3. All disputes arising out of the implementation of these Rules shall be settled by negotiation. If no agreement is reached, disputes shall be settled in accordance with the laws of the Republic of Lithuania.

15.4. The Parties shall be released from the obligations under these Rules if they cannot be fulfilled due to unforeseen circumstances beyond the control of the Parties, which include:

• fire, explosion, storms and other natural disasters and forces of nature which prevent or delay the fulfillment of commitments;

• an event or circumstance beyond the control of the party (parties) which prevents or delays the performance of the obligations assumed;

• Actions by the government or government that prevent or delay the implementation of commitments.
